Gode Gate acts as an agent for the property owner of accommodation featured on our website, and is liable only as an agent. The rental agreement is actualy between you as a lessee (guest) and villa owner as a lessor (Owner).
By making a reservation for a particular period for a specific villa, you as a guest unconditionally accept this general conditions, that came into force on the day they were published on web page

All the annexes to the rental contract shall be valid only if made in a written form.
1.1 Once you have made a provisional reservation with us we will ask you to confirm your booking by e-mail. This must be from the first named person on the booking (‘the party leader’). The party leader must be at least 21 years of age on the villa reservation day, and must be authorised to make the booking on the basis of these booking conditions by all persons named on the booking. By confirming the booking details with Gode Gate the party leader confirms that he/she is so authorised and that all party members agree to be bound by the booking conditions.
1.2 The party leader is responsible for making all payments due to us. Once an invoice has been sent out from Gode Gate a minimum non-refundable deposit of 30% of the rental cost must be sent, after wich the reservation is confirmed, the contract with the owner is concluded and General conditions, wich make a constintuent part of the villa rental contract are accepted. It the payment has not been made within three days, Gode Gate is allowed to conclude a new rental agreement with another guest. A higher deposit may be required where additional terms have been imposed on us by the property owner.
1.3 A contract between you, the party leader and the property owner will come into existence when you have paid a deposit (or full payment if booking within 30 days from check in) and we accept your booking by issuing a written confirmation. Croatian Law governs your contract and all matters arising out of it. Any disputes, claim or other matter, which arises out of or in connection with this contract, will be dealt with by the courts of Croatia only.
It is important that you check the villa confirmation you receive from us immediately on receipt. You must contact us straight away if any information appears to be incorrect as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracies in any document within 14 days of our sending it out.
a) Reservations made 30 days or more before check in.
Deposit advance payment of 30% of the total agreed villa price must be paid immediately. Gode Gate needs to receive payment within 3 days. The rest of 70% of the total agreed villa price must be paid not later than 45 days before check in.
b) Reservations made less than 30 days before check in date.
Total agreed villa price must be paid immediately.
1.4 The guest is obliged to make payments within the period and in a way described in this clause of the General Conditions. If the guest does not obey the payment due dates, such behaviour is considered a severe breach of contract obligations and the Rental Contract is considered terminated without the notice period, and Gode Gate is not obliged to inform the guest about it. Gode Gate shall, although it is not obliged, but in accordance with its business policy of a special appreciation of its guests, send the guest a notice as a reminder of the payment obligation with an appropriate fulfilment period. At the occasion of the contract termination all the payments made to Gode Gate shall not be returned.
2.1 The price of villa is visible on our web site. They are stated for a week period. Properties are let fully furnished and equipped. The price for all properties includes linen, electricity, hot and cold water, air conditioning/heating. Where there is a private pool, pool heating might incur as an additional expense. Satellite/Cable television where available may not include access to all channels. If internet access is available it is generally assumed that the customer will bring their own laptop. Fax machine means a fax machine can be provided. Use of telephone facilities must be paid for locally.
2.2 Gode Gate guarantees that the price stated on our web page is the lowest price you can find for the specific villa in the specific period. In case, that at the time of the booking process you find the same villa, in a given rental period, for a lower price than ours, we offer you a 5% discount on the found prices. To gain a 5% discount you must send us evidence of more affordable price. Discount is not applicable if the lower price is a result of the tax or stamp duty, increase, change in exchange rate, if it is not up to date, and guests cannot actually book for that price, or it is a result of special last minute offer. 5% discount can be used if given valid evidence only at the moment of reservation, and can not be applied later or after the reservation is already paid for.
3.1 ARRIVAL AND DEPARTURE
Guests are expected to arrive between 3.00 pm and 8.00 pm Croatian time and to depart by 10.00 am. There may be slight variations to these times +/- one hour – you will be advised of the correct Arrival/Departure times for your property on your travel documentation. The time of arrival and departure wich is mentioned in confirmation is unchangable, and guest has to obey it. In the case of late check out than agreed one, the guest are charged on the spot, and are obliged to pay to the owner any additional costs, wich incured.
3.2 HANDOVER OF THE KEYS
In booking confirmation you will receive exact adress of the villa and contact details of person that will be at check in. In communication with villa owner you will organise handover of the keys. Comon practice is that you are met at the villa. Hand over of the keys can be refused if the full amount of villa rental is not paid.
3.3 IDENTIFICATION
At the time of check in guest will be asked to show to the owner/villa representative official identification documents that contain personal details. Thoose details are necessary for registration in the national tourist board (HTZ). Information will not be used for any other purposes. It is a legal obligation to register every guest, therefore, a guest that does not want to provide any form of personal identification may be denided access to the villa. The party leader is responsible for the parties taking with them correct travel documentation (passports and visas, driving licences, vehicle registration, green card, motor insurance etc).
3.4 NUMBER OF PEOPLE USING THE PROPERTY
The maximum number of people, including children, allowed at the property may not be exceeded. The children up to one year are excluded if announced. Guest is allowed to increse number of person, up to maximum capacity, no later than seven days before check in. This request should be sent in writting. If the guest expects visitors during the lease period owner must be informed. The total number of guests and visitors at the property can not exceed maximum number of guests that owner allowed. The owner has the right to terminate the rental without prior notice and without refund if the numbers of guests or visitors are exceeded, and the guest, together with all person wich staid in villa are obliged to leave within two hours, and are not entiteld to demand the return of paid summ.
3.5 YOUTH
In case that the guests are younger than 25 years, they are obliged to inform Gode Gate immediately at the reservation about the exact number of guests and their age. In this case a payment of an additional deposit might be necessary for property damage. Gode Gate and the owner retain the right to reject the groups of guests younger than 25 years in case that Gode Gate has not been informed about their arrival, and in that case the guests are not entitled to a return of the paid accommodation price.
3.6 BEHAVIOUR
The person signing the contract is responsible for the correct and decent behaviour of the guests. In case a guest disturb public order by noise or any other way, and do not calm down after a warning. Gode Gate or the villa owner may use their absolute discretion and ask guest permanently leave the villa within two hours without refund. Guests must keep the property and all furniture, fittings, effects, facilities, equipment and grounds in the same state of repair and condition as at the commencement of holiday, and in the same state of cleanliness and general order in which it was found. Guests will be responsible for any breakages, loss or damage to the property. Once again we strongly recommend adequate insurance cover to be made by yourselves and all party members. The property owner reserves the right to make deductions from the security deposit for any extra cleaning over the number of hours committed to Till cleaning, and to claim compensation for costs over and above the sum of the security deposit.
3.7 LINEN
Linen and linen change is included in all properties. It is advisable to take a beach towel and to check that cot linen is provided.
3.8 SWIMMING POOLS
Swimming pools are not open all year. Please check with us as whether the pool is open or not. If pool heating is offered then an extra charge may inquier. The guest is responsible for using a swimming pool in any sense at his/her own responsability. The children must not be left in pool area without adult supervision. Usage of whirpools is at your own risk and responsability. The water in the whirlpools might not be warm until the late evening hours on the day of the guest`s arrival. It is forbidden to stay on the whirlpool lids. The lids are used for isolation, they are not designed and adjusted to bear weight of a person and can be easily broken. In case that the lid is broken, the guest is obliged to compensate damage directly to the owner.
3.9 SOCIAL EVENTS AND OTHER FUNCTIONS
Gode Gate acts as an agent for property owners for the private rental of a property. If you are intending to organise a private function (e.g. party, wedding, cocktail party) at the property, you must seek prior permission from Gode Gate. Additional charges and/or increased security deposit may be sought at the owner’s discretion.
3.10 SECURITY AND VALUABLES
Any valuables left at the property are left at your own risk. Neither Gode Gate nor the property owner is responsible for their loss. Where provided, burglar alarms must be activated, safes used and proper care taken against theft and burglary. We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident howsoever caused. No refund can be given should you decide to vacate the property as a consequence of a burglary.
3.11 PETS
Pets are not allowed unless with the explicit permission of the owner. The owner reserves the right to add a surcharge and/or increase the security deposit. Number of pets must be agreed prior to acceptance of booking. Pet owner is responsible for cleaning of pet waste after their pet. Pets are not allowed to sit on furniture and to go into swimming pool at any time. Pets must be vacinated acording to low. Gode Gate and the owner are not responsible for a possible injury or ilness the pet might suffer during the stay. Gode Gate can not guarantee that villa that does not allow pets is completely safe for thoose that have allergic reactions and can not held responsible if thoose accure in any of the villas.
3.12 ENVIRONMENT
In case you booked a newly built villa be avare that maibe there was not enough time for grass, plants to grow and that horticulture may not be on top level. Please be aware that many of our properties are in rural or isolated locations and as such you may encounter flora and fauna such as mosquitoes, wasps, ants, local dogs etc as well as other environmental activities e.g. farming, drains etc. Some properties are located on non-surfaced roads. Please note we cannot be held responsible for any building or road workings occurring near the property. We will endeavour to advise you of any work occurring should we be aware of it, but work can occur at any time without our prior knowledge. Neither the Gode Gate nor the villa owner can be held responsible for noise that may arise from the above metioned.
3.13 LOW SLUNG CARS
Guests taking low/sports cars are advised to check that the access to the property is suitable.
3.14 TENTS AND CAMP TRAILERS
It is forbidden to build tends or bring camp trailers or similar. The owner or Gode Gate are authorized to demand that the above mentioned is removed without delay. If the guest does not fulfill the mentioned requests without delay, the owner and/or Gode Gate are authorized to terminate the lease agreement which comes into force immediately, without a notice period, and the guest is obliged to leave the villa permanently together with all the persons which stay there within 2 (two) hours, and he is not entitled to demand a return of the paid accommodation price from the owner or Gode Gate.
3.15 ACCESS
The property owner or their representative shall be allowed reasonable access to the property to carry out urgent maintenance and/or inspection.
3.16 TECHNICAL EQUIPMENT
Villas contain all necessary devices, technical equipment and other conveniences which secure a pleasant stay to the guest. The owner is obliged to secure the proper function of all devices in the villa. In case of a non-function or failure of any of the devices the guest shall inform the owner and/or Gode Gate about the occurred situation so that Gode Gate could demand from the owner to organise the repair and remove the failure as soon as possible. The owner is obliged to remove the reported failure within a reasonable period. The owner is liable directly to the owner for the failures, and Gode Gate shall undertake everything possible to repair or remove the failures or other irregularities in the shortest possible period.
3.17 DESCRIPTION
While we make every effort to ensure that descriptions supplied are accurate, we cannot accept responsibility for errors contained therein or the results thereof. You must accept that minor differences between the photograph/illustration/text used and actual property may arise. Property owners reserve the right to make modifications to the property specifications that are considered necessary in light of operating requirements. In the interest of continual improvement, property owners reserve the right to alter furniture, fittings, amenities, facilities or any part of any activities, either advertised or previously available without prior notice. The owner is exclusively liable for giving accurate and complete information about the villa, Gode Gate can not be concidered liable in case of inacurate incomplete or false information.
Please give as much time as possible to organise additional services. Payment for such services is usually made locally (excluding car hire). We cannot accept responsibility for any extra services provided by third parties.
5.1 CHANGES
If you are prevented from travelling, you have a right to transfer your villa to another person in the same period, for the same price, and under same conditions. After we receive all the information of the new guests, Gode Gate will issue new rental agreement and the new guest will be obliged to pay the rest up to the total accommodation price. Any such change must be sent in writing 14 days before arrival. You will also be liable for any additional costs caused by this transfer. Until we receive full payment, both you and the person taking your place are responsible for full payment of the villa. In case villa is not available due to the act of God (earthquake, floode, fire, ...) Gode Gate and owner are not liable for canceled reservations. If it is possible the guest will be offered another villa or a money refund.
5.2 CANCELLATION
If you wish to cancel your booking you may do so either by writing to us, e-mailing us at info@zadarvillas.com All Cancellations will take effect from the date received by Gode Gate. In all cases a cancellation will only be accepted from the party leader. If you do cancel you will have to pay cancellation charges. The amount you pay depends on the date we have been informed of the cancellation in writing. We strongly advise taking a travel insurance. The following cancellation charges apply:
43 days prior to villa check in..................free cancelation
42-29 days prior to villa check in................65% of total cost
28-15 days prior to villa check in ................80% of total cost
Less than 15 days prior to check in................100% of total cost
***This cancellation policy is applied only for new bookings from 10th of April 2021.
5.3 COMPLAINTS
If guest notice a problem with the villa such as (demage, insuficient cleaning, ....) at check in, contact the owner immediately, and give apropriate time to settle the complaint and fix a problem. If the complaint is not settled in a satisfactory way for the guest, the guest shall contact directly Gode Gate by phone or email in order to settle the claim in a satisfactory way. It is an obligation of the guest to try to avoid the damage occurrence or its expansion and to contribute the effort to minimize any loss for the owner. In case of filing of any complaints the guest is obliged to give an appropriate term to the owner to settle the complaint.
Gode Gate has checked the object condition at the contract conclusion with the owner, and it is not liable for possible additional deviations from the provided information mentioned on the web page. The guest`s departure from the villa before the end of the foreseen rent and without the previous notice and agreement with Gode Gate shall be at risk and costs of the guest, and Gode Gate has no liability. If the guest does not leave an appropriate term to the object owner for the removal of irregularities related to the damage repair or move to another villa he/she loses right to them, and in that case he/she cannot terminate the concluded Rental Contract. The owner is exclusively liable to the guest for a possible direct property damage. Neither Gode Gate nor the owner can be considered liable for any form of a non-material damage in the form of a breach of personality right. If you vacate the property before the the day that was set as you departure day from villa without notifying our local representatives you will lose the right to compensation.
A demage deposit is required to cover the cost of any damages or breakages. The deposit serves as a security to the owner for caused damages in the villa, and the owner is entitled to cover the damage from the deposit. In case that the caused damage is higher than the deposited sum, the guest is obliged to pay the total damage amount to the owner. If no damage is caused to the villa, the owner is obliged to return the deposited sum to the guest at the takeover of keys at the guest`s departure.
The deposit will be collected on your arrival to the villa and is usually € 200 - € 1000 per villa. For telephone use or other additional services a higher deposit may be required to cover eventual bills. You will be advised of this at the time of booking or if you decide on your arrival that you wish to use additional services the higher deposit will be confirmed to you in villa. Please ensure you have this amount of money ready when you arrive otherwise entry into the property may be delayed until the deposit is produced.
An intentional property damage or disturbance of public order is considered a severe breach of provisions of the Rental contract, in which case the owner and/or Gode Gate are authorised to terminate the Rental contract which comes into force immediately, without the notice period, and the guest is obliged to permanently leave the villa within 2(two) hours together with all the persons which stay there, and he/she is not entitled to demand a return of the paid accommodation price from the owner or Gode Gate. The guest is obliged to report to the owner immediately the occurrence of any kind of damage on the villa or property around the villa during the rental period. At the guest`s departure and before the return of keys, the guest is obliged to examine the villa and the property around the villa with the owner. It can be considered that a damage is also a need for an additional cleaning due to the especially bad condition in which the guest returned the villa to the owner, and the owner is entitled to use a deposit to cover that damage. The deposit is usually refunded as the end of your stay subject to an inspection of the villa for damage. In some instances delays of up to 8 weeks in returning the deposit are caused due to awaiting utility bills or proof of damage. No calls will be made to the owner to speed up the receipt of bills until 4 weeks after the return date. Gode Gate has no liability for the possibly caused damages to the owner or to the guest if he/she does not want to return the deposit. All possible disputes the owner and the guest shall settle among themselves without Gode Gate.
Neither Gode Gate (as agent for the property owner) nor the property owner shall be responsible for the death of, or personal injury of any member of a booking party, or of any other person at the property. We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including though not limited to acts of God, explosion, tempest, fire or accident, war or threat of war, civil disturbances, acts, restrictions, regulations, bye-laws or measures of any kind on the part of the government or local authority, strikes, lock-outs or other industrial actions or disputes or adverse weather conditions. In any case we shall be entitled to treat the contract as discharged. On the event of discharge our liability shall be limited to the return of the sums paid to us in respect of the unused portion of the rental calculated on a pro rate daily basis less an administrative fee of Euro 50.00 to cover our reasonable expenses.
We cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtrations systems, nor for the failure of public utilities such as water, gas and electricity.
We cannot accept responsibility for events out of our control e.g. bad weather including events arising as a result of very hot or unusual weather, delays caused by carrier companies, breakdown of domestic equipment.
The contracting parties shall try to settle all possible disputes in an agreement. In case of any dispute the parties agree the competence of the competent Court in Zadar and the application of the Croatian law.
From time to time we may establish links from the Gode Gates website to other sites which we feel would be of interest to customers planning a villa holiday. Gode Gate would like to make it clear that we are not responsible for the actions or content of these websites. It is your responsibility to check the status of these sites.
